6. Invalid Gift Card. 3. The Gift Card must not have an expiration date.

  • A $5 fee will be assessed to reissue a check after the 30 day expiration date has lapsed, and this fee will be waived if the user maintains a bulk seller account in good standing;
  • A $25 fee will be assessed to reissue a check prior to the lapse of the 30 day expiration date;
  • Each Seller may make one payment request per day.
  • All payment requests will be processed once per business day at 2PM Central.

9. Removal of Listed Gift Cards. All sales are final in the Raise Marketplace; however, Raise strives to protect you as a Buyer from a loss resulting from purchasing an invalid, fraudulent or stolen Gift Card. Notwithstanding anything to the contrary contained herein, Raise’s liability to you for any loss, damage or injury suffered by you in any way related to the Site or any Products or services used or purchased by you, or for any breach of any term or condition of this Agreement, or for any Damages, regardless of the form of action, will at all times be limited to the LESSER of the following:

  1. the sum total of all purchases made by you during the thirty (30) day period prior to the date you notify us that you have suffered a loss or injury of any kind;
  2. two hundred and fifty ($250) dollars; or
  3. the Lost Value of the gift card, coupon or other Product that was purchased and is the subject of a claim for loss, provided, however, that we can reasonably determine the Lost Value and you fully cooperate in our investigation regarding the Lost Value.

“Lost Value” shall mean the difference between the monetary value of the Product that you expected to receive based on the description of the Product at the time of sale and the terms and conditions associated with the Product from the issuing merchant of the Product, and the actual value which could be redeemed from the merchant by tendering the Product and complying with all the terms and conditions set by the merchant. For example, if you purchased a gift card that was described as having a value of $100, and you presented the Product to the relevant merchant and discovered that the Product had a remaining value or balance of $80, the Lost Value would be $20. These limitations shall apply to the fullest extent permitted by the applicable law.

Please review the section labeled “Disputes” for procedures following the event of a dispute or claim. Please note that your limited rights as set forth under this section may be forfeited or waived if you fail to provide proper notice or comply with other terms and conditions set forth under the section labeled “Disputes”.

10. Commission and Fees. Registration on the Site is free, but Raise charges sales commission and listing fees that cover the costs associated with running the Site. The User agrees that the commission and listing fees are paid by the Seller from the proceeds of the sale and are deducted from the sale proceeds prior to crediting the Seller’s Raise account balance. The sales commission is fifteen percent (15%) of the gift card sale price. For physical gift cards, the selling fee is the greater of $1.00 or 1% of the balance. There is no selling fee associated with electronic cards. For example, if you sell a physical gift card with a balance of $100 and a sale price of $90, the commission is $13.5, the selling fee is $1, and Raise will make $75.50 available to you in your user account.

Arbitration

We will make every reasonable effort to resolve any disagreements that you have with Raise. If those efforts fail, by using this site you agree that any claim, dispute, or controversy you may have against Raise arising out of, relating to, or connected in any way with this Agreement, this site, or the purchase or sale of any voucher(s), shall be resolved exclusively by final and binding arbitration administered by the American Arbitration Association (“AAA”) and conducted before a single arbitrator pursuant to the applicable Rules and Procedures established by AAA (“Rules and Procedures”). You agree further that: (a) the arbitration shall be held at a location determined by AAA pursuant to the Rules and Procedures (provided that such location is reasonably convenient for you), or at such other location as may be mutually agreed upon by you and CouponTrade; (b) the arbitrator shall apply Illinois law consistent with the Federal Arbitration Act and applicable statutes of limitations, and shall honor claims of privilege recognized at law; (c) there shall be no authority for any claims to be arbitrated on a class or representative basis; arbitration can decide only your and/or Raise’s individual claims; and the arbitrator may not consolidate or join the claims of other persons or parties who may be similarly situated; (d) in the event that you are able to demonstrate that the costs of arbitration will be prohibitive as compared to the costs of litigation, Raise will pay as much of your filing and hearing fees in connection with the arbitration as the arbitrator deems necessary to prevent the arbitration from being cost-prohibitive; and (e) with the exception of subpart (c) above, if any part of this arbitration provision is deemed to be invalid, unenforceable or illegal, or otherwise conflicts with the Rules and Procedures established by AAA, then the balance of this arbitration provision shall remain in effect and shall be construed in accordance with its terms as if the invalid, unenforceable, illegal or conflicting provision were not contained herein. If, however, subpart (c) is found to be invalid, unenforceable or illegal, then the entirety of this Arbitration Provision shall be null and void, and neither you nor Raise shall be entitled to arbitrate their dispute.
